An ethical report by the Law Society of Maine concluded that a lawyer violated the adequacy standard by giving a client the opportunity to defend an ethical complaint, even if the complaint was filed by the opposite party in the underlying case and not by the client. In The Law Society`s 139 (1994) Ethics Notice found that an offence occurred even when the opposing party presented the complaint as a tactical and reckless manoeuvre to push counsel to withdraw from the representation, counsel faced considerable costs in the fight and the client knowingly accepted the royalty agreement. The Law Society`s Ethics Committee noted that the defence against a professional behaviour complaint “cannot under any circumstances be construed as a transfer of legal services to a client.” In California, legal advertising cannot contain a guarantee for the outcome of a legal case or a formulation that implies that the lawyer may receive immediate money or prompt billing for a potential client.  The advertisement must not include a celebrity spokesperson unless the spokesperson`s title is disclosed.  Note that this prohibition on payment of recommendations does not exclude the payment of advertising or initiation fees for a legal service and does not exclude giving nominal gifts as an expression of appreciation and not as a form of compensation.  The Commission recommends that the current wording of this rule be maintained, with the sole exception that the client must accept the participation of each lawyer and that the agreement must be confirmed in writing, including the share of the tax that each lawyer will receive. The courts have held that it is unreasonable for lawyers to calculate to clients the time spent learning basic material law in a case.  A number of the Ethics Committee`s opinions have interpreted the current rule of the model to authorize conditional fees in family law cases under the Order-in-Council, i.e. the collection of arrears reduced to judgments, because these pricing rules do not relate to the same political cases that coincide with the fact that fees depend on the guarantee of divorce or the amount of support. , help or property.
